Terms of Service

1. Provider and scope

The SunDating app and events are operated by OM OceanMedia Ltd (Oum Charam, Pelagos Court, Office 01, 6027 Larnaca, Cyprus) (below „SunDating" or „we"). These Terms of Service govern all contracts between you and us concluded through the SunDating app and the website sundating.app.

2. Services

SunDating is a dating platform for expats on selected islands. We offer:

• a free basic profile
• a 3-day free Trial
• paid memberships („Plus" and „VIP")
• a Trip Pass with day-based duration for short-stay visitors
• physical SunDating meetups („Crawls") in public venues on the respective island
• optional AI features billed via AI Coins

SunDating is a facilitation platform. We are not the organiser of the Crawls in the legal sense; we introduce users to each other and announce times and public venues.

3. Registration and user requirements

To use SunDating you must (a) be at least 18 years old, (b) be unmarried or single, (c) have a genuine interest in meeting and dating. You warrant that all statements in your profile are truthful. Each user may only maintain one profile.

4. Contract conclusion and right of withdrawal

A paid membership contract is concluded upon completion of the payment process. As a consumer you have a 14-day right of withdrawal from contract conclusion without stating reasons. Upon withdrawal we refund payments already made, minus proven costs for services already used (e.g. event attendance).

5. Prices, payment and cancellation

Current prices are shown in the app under „Membership". Payment is processed via Stripe. Memberships auto-renew monthly unless cancelled before the end of the current period. Cancellation can be done at any time in the app and takes effect at the end of the paid period.

6. AI Coins

AI Coins are virtual credits for AI-based features (photo enhancement, text suggestions, chat replies). New „Plus" or „VIP" subscribers receive 100 coins for free on their first upgrade. Additional coins can be purchased in packages. Coins are not redeemable for cash, not transferable to other users, and expire when your account is deleted.

7. SunDating Crawls

Legal classification

Crawls are informal meetups of SunDating members in public venues (bars, cafés, restaurants) operated by third parties. SunDating acts solely as a facilitator: we provide the time, the venue and the composition of the participant group. We are not the organiser of these meetups and accept no liability for the course of events, the safety or the equipment of the venues, or the conduct of other participants.

On-site consumption

Drinks, food and other consumption are billed exclusively by the venue operators and must be paid by the user themselves. No contract arises between SunDating and the user regarding consumption or the use of the premises.

Own responsibility

Attendance at a Crawl is at the user's own responsibility and own risk. Each user is responsible for complying with applicable law and house rules, for responsible alcohol consumption, and for their own travel to and from the venues.

Registration and cancellation

Registration is done through the app. After signing up, if you cancel you may only re-register on the day of the Crawl itself and only if seats remain. Repeated last-minute cancellations or no-shows can lead to a temporary suspension from future Crawls.

8. Conduct in the app and at events

You commit to treating other users respectfully. Prohibited in particular: insults, harassment, sexually explicit content, commercial advertising, sharing others' contact details, commercial services (e.g. prostitution). Violations may lead to account suspension without refund. Other users can report you through the app.

9. Limitations

SunDating facilitates encounters — we are not an event organiser, not a matchmaking agency and not an escort agency. We do not guarantee relationship success, matches, a minimum number of connections or a specific composition of participants at Crawls. We assume no responsibility for the conduct of other users — neither in the app nor at physical meetups. Personal arrangements and meetings happen exclusively at the users' own responsibility.

11. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body and health. For simple negligence we are liable only for breach of material contractual obligations, limited to the damage typically foreseeable for this contract.

Our liability is excluded in particular for damages caused by the conduct of other users at Crawls or at privately arranged meetings, and for incidents at the venues in which Crawls take place — these are the responsibility of the respective operators.

12. Changes to these Terms

We may amend these Terms when required for good cause. We inform you of material changes at least 4 weeks in advance via email and in the app. If you do not object, the change is deemed accepted.

13. Applicable law and jurisdiction

The law of Cyprus applies. Jurisdiction for merchants is Larnaca, Cyprus. Mandatory consumer protection provisions of your country of residence apply.

14. Severability

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
